1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of Route Limo's ("we," "our," or "us") limousine and chauffeur services, including our booking platform, mobile application, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use our Services. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the Services after modifications constitutes acceptance of the updated Terms.

2. Services Description

Route Limo provides premium limousine and chauffeur-driven transportation services, including but not limited to:

• Airport transfers and ground transportation
• City-to-city and intercity transportation
• Hourly chauffeur services
• Event and wedding transportation
• Corporate and executive transportation
• Special occasion and luxury vehicle rentals

3. Booking and Payment Terms

3.1 Booking Requirements

• All bookings must be made through our official platform, website, mobile app, or authorized customer service representatives
• You must provide accurate and complete information, including pickup and drop-off locations, dates, times, and passenger count
• Bookings are subject to availability and confirmation
• We reserve the right to refuse service to anyone for any lawful reason

3.2 Payment Terms

• Payment is required at the time of booking, unless otherwise agreed in writing
• We accept major credit cards, debit cards, and other payment methods as indicated on our platform
• All prices are quoted in the currency displayed and are subject to applicable taxes and fees
• Additional charges may apply for waiting time, extra stops, tolls, parking, and gratuities
• Refunds are subject to our cancellation and refund policy (see Section 5)

4. Communication Services and Ring Central TCR

4.1 Communication Methods

We use various communication channels, including Ring Central and other telecommunications service providers, to facilitate communications between customers, drivers, and our customer service team. These communications may include voice calls, SMS messages, MMS messages, and email notifications.

4.2 Ring Central TCR (Telecommunications Compliance Review)

By using our Services, you acknowledge and agree to the following conditions related to our use of Ring Central and compliance with telecommunications regulations:

• Call Recording: Customer service calls may be recorded for quality assurance, training, compliance, and dispute resolution purposes. You will be notified at the beginning of calls that may be recorded. Recordings are stored securely and in compliance with applicable laws.
• Data Protection: Phone numbers and communication records are treated as confidential personal information and are protected in accordance with our Privacy Policy and applicable data protection laws, including GDPR, CCPA, and TCPA requirements.
• Message and Data Rates: Standard message and data rates may apply to SMS and MMS communications. You are responsible for any charges from your telecommunications provider.
• Accuracy of Information: You are responsible for providing accurate and current contact information, including phone numbers. Failure to do so may result in missed communications and service disruptions.
• Third-Party Service Providers: Ring Central and other communication service providers are contractually bound to comply with all applicable telecommunications regulations, maintain TCR approval status, and protect your information in accordance with industry standards.
• Prohibited Uses: You agree not to use our communication services for any unlawful purpose, including but not limited to harassment, spam, fraud, or violation of telecommunications regulations.
• Compliance Monitoring: We regularly audit and monitor our communication practices to ensure ongoing compliance with TCPA, CAN-SPAM Act, GDPR, and other relevant regulations. Any violations will be promptly addressed.
• Dispute Resolution: If you have concerns about our communication practices, wish to file a complaint, or need to update your communication preferences, please contact us immediately at contact@routelimo.com or +1 (929) 813-4060.
• Changes to Communication Terms: We reserve the right to modify our communication practices and these terms, provided that any material changes will be communicated to you and will comply with applicable regulations.

4.3 SMS Text Messaging Disclosure

5. Cancellation and Refund Policy

5.1 Cancellation by Customer

• Cancellations made 48 hours or more before scheduled pickup: Full refund minus processing fees
• Cancellations made 24-48 hours before scheduled pickup: 50% refund
• Cancellations made less than 24 hours before scheduled pickup: No refund
• No-show without cancellation: No refund
• Cancellation policies may vary for special events, holidays, or customized bookings

5.2 Cancellation by Service Provider

If we must cancel your booking due to circumstances beyond our control (weather, vehicle issues, driver unavailability, etc.), we will provide a full refund or reschedule at no additional charge, at your option.

In the event of a cancellation by Route Limo, we will make every reasonable effort to notify you as soon as possible. We may attempt to provide an alternative vehicle or driver if available. If we are unable to provide a suitable alternative and you choose a refund, processing will typically be completed within 5-10 business days to your original payment method.

For bookings canceled due to extreme weather conditions, natural disasters, or government-imposed restrictions, we will work with you to find the best solution, which may include full refund, partial refund with credit for future bookings, or rescheduling to a mutually agreeable date.

6. Service Standards and Responsibilities

6.1 Our Responsibilities

• Provide professional, licensed, and insured drivers
• Maintain vehicles in safe and clean condition
• Arrive on time or provide timely updates in case of delays
• Ensure driver compliance with all applicable laws and regulations
• Maintain appropriate insurance coverage

6.2 Customer Responsibilities

• Provide accurate booking information
• Be ready for pickup at the scheduled time
• Comply with all applicable laws and regulations during the ride
• Treat drivers and vehicles with respect
• Notify us immediately of any issues or concerns
• Ensure the number of passengers does not exceed the vehicle's capacity

7. Liability and Insurance

We maintain comprehensive commercial liability insurance as required by law. However, we are not liable for:

• Delays caused by traffic, weather, accidents, or circumstances beyond our control
• Loss or damage to personal property left in vehicles
• Consequential or indirect damages
• Acts or omissions of third parties
• Personal injury resulting from customer negligence or misconduct

Our total liability for any claim shall not exceed the total amount paid for the specific service giving rise to the claim.

8. Prohibited Conduct

The following conduct is strictly prohibited:

• Smoking, vaping, or using tobacco products in vehicles
• Consuming illegal substances or excessive alcohol
• Engaging in illegal activities
• Harassing, threatening, or abusing drivers or other passengers
• Damaging or defacing vehicles
• Interfering with driver's ability to operate the vehicle safely
• Exceeding the maximum passenger capacity

Violation of these prohibitions may result in immediate termination of service, removal from the vehicle, and liability for damages.

9. Intellectual Property

All content, trademarks, logos, and intellectual property on our platform are owned by Route Limo or our licensors. This includes but is not limited to website design, text, graphics, images, logos, icons, audio clips, digital downloads, data compilations, software, and the compilation of all content on our site. You may not use, reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any content without our prior written permission.

The "Route Limo" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Route Limo or its affiliates or licensors. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on our Services are the trademarks of their respective owners.

Any unauthorized use of our intellectual property may violate copyright laws, trademark laws, privacy and publicity laws, and communications regulations and statutes. We reserve the right to pursue legal action against any unauthorized use of our intellectual property, including seeking injunctive relief and monetary damages.

10. Dispute Resolution

Any disputes arising from these Terms or our Services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

Informal Resolution: Before initiating formal dispute resolution proceedings, you agree to first contact Route Limo directly to seek an informal resolution. We are committed to resolving disputes fairly and efficiently. Arbitration: If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted by a single arbitrator selected in accordance with AAA rules. The arbitrator's decision will be final and binding, and judgment on the arbitrator's award may be entered in any court having jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, we both waive any right to a jury trial.

Exceptions: Notwithstanding the foregoing, either party may bring suit in court to seek injunctive or other equitable relief to protect intellectual property rights, or to enforce or challenge the enforceability of the arbitration provision itself.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Route Limo operates, without regard to conflict of law principles.

For purposes of these Terms, "jurisdiction" refers to the state, province, or country in which Route Limo's principal place of business is located. This governing law provision applies to all aspects of the relationship between you and Route Limo, including contract formation, performance, interpretation, and enforcement of these Terms.

If you are accessing our Services from outside the United States, you acknowledge and agree that your use of our Services may be subject to the laws of the United States and the state in which Route Limo operates, in addition to any applicable local laws. You are responsible for compliance with all applicable laws, regulations, and rules in your jurisdiction.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision will be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if such modification is not possible, such provision will be severed from these Terms.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision. If a court determines that any provision is invalid or unenforceable, the parties intend that such provision be replaced with a valid and enforceable provision that most closely approximates the intent and economic effect of the invalid or unenforceable provision.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Route Limo regarding the use of our Services.

This agreement supersedes all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Route Limo relating to the subject matter of these Terms. No modification, amendment, or waiver of any provision of these Terms shall be effective unless in writing and signed by both parties, except as otherwise expressly provided in these Terms.

These Terms, together with our Privacy Policy, Legal Notice, and any additional terms and conditions that may apply to specific services, features, or promotions, form the complete and exclusive statement of the agreement between you and Route Limo. No course of dealing, usage of trade, or course of performance shall be used to modify, interpret, supplement, or alter in any manner these Terms.

If you have entered into a separate written agreement with Route Limo regarding the use of specific services or features, that agreement shall take precedence over these Terms only with respect to the specific services or features covered by that separate agreement. In all other respects, these Terms shall apply.
